However, the cutoff applies only to those seeking to lead a proposed securities class action against the crypto custodian.<\/p>\n<p>Over the past few days, several law firms, including DJS Law Group, Faruqi &amp; Faruqi, and Schall Brown &amp; Schwartz, have issued notices. They urged the crypto custodian\u2019s shareholders to act by Aug. 7.<\/p>\n<p>However, the disclosures clarify that appointment as lead plaintiff is not required to participate in any eventual financial recovery.<\/p>\n<p>Under the Private Securities Litigation Reform Act, the 60-day window sets the lead-plaintiff process. It determines who may petition the court to oversee the litigation and select counsel. The law generally favors a qualified candidate with the largest financial interest. That candidate must also satisfy applicable class-action requirements.<\/p>\n<p>This means investors who do not seek the lead role do not need to act by Aug. 7. Separate opt-out or proof-of-claim deadlines could arise later if the litigation progresses.<\/p>\n<h2>BitGo\u2019s own filings sit at the center of the dispute<\/h2>\n<p>The Aug. 7 deadline stems from <em>Arsenault v. BitGo Holdings<\/em>, a lawsuit filed June 8 in the US District Court for the Eastern District of New York.<\/p>\n<p>The complaint alleged BitGo and its executives downplayed their vulnerability to declining digital-asset prices in the firm\u2019s prospectus. At the time, it said a hypothetical 50% change in Bitcoin&#8217;s fair value would have altered its net income for the first nine months of 2025. It estimated the change at approximately $135.1 million.<\/p>\n<p>That exposure later became visible in BitGo&#8217;s results. The company reported a $60.7 million loss during the first quarter. That included a $53.7 million unrealized digital-asset loss, while staking revenue fell 66.2% amid lower token prices.<\/p>\n<p>BitGo, a major crypto custodian with over $100 billion in assets, went public this year.
