They apply to issuers under the OCC\u2019s jurisdiction, including certain foreign stablecoin companies, and will take effect on 18 January 2027.<\/p>\n<p class=\"wp-block-paragraph\">Rules concerning anti-money laundering and sanctions will be addressed separately in coordination with the US Treasury.<\/p>\n<p class=\"wp-block-paragraph\"><strong>Read also:<\/strong> <strong>Pet Rock No More? JPMorgan Sees Bitcoin Outperforming Stocks and Gold<\/strong><\/p>\n<p class=\"wp-block-paragraph\">US Treasury Secretary Scott Bessent called the GENIUS Act a \u201cwatershed moment in American finance\u201d and said it would secure US leadership in the space, comparing the law to Abraham Lincoln\u2019s National Currency Act.<\/p>\n<div id=\"blockquote-block_6616a7123b96930b522c0a2e36ff861b\" class=\"blockquote-container variant-personal\">\n<div class=\"blockquote-text\">\n<p>Just as President Abraham Lincoln\u2019s National Currency Act of 1863 established a national framework for bank-issued currency, the GENIUS Act establishes a federal framework for payment stablecoins in the digital age.<\/p>\n<\/div>\n<div class=\"blockquote-attribution\">\n        <img decoding=\"async\" class=\"author-image lazyload\" src=\"https:\/\/cdn.cryptonews.com.au\/2024\/11\/25124837\/Screenshot-2024-11-25-104824.png\"\/><img decoding=\"async\" src=\"https:\/\/cdn.cryptonews.com.au\/2024\/11\/25124837\/Screenshot-2024-11-25-104824.png\" class=\"author-image\" data-eio=\"l\"\/>        US Treasury Secretary Scott Bessent    <\/div>\n<\/div>\n<p class=\"wp-block-paragraph\">While the OCC has finalised its stablecoin regulations, the broader question of how other cryptos should be classified remains unresolved.<\/p>\n<h2 id=\"h-industry-responds-to-sec-proposal\" class=\"wp-block-heading\">Industry Responds to SEC Proposal<\/h2>\n<p class=\"wp-block-paragraph\">On 18 August, the SEC proposed a new framework called Regulation Crypto Assets, which would clarify how securities laws apply to investment contracts involving crypto assets. The period for public comments closed on 20 October, and several blockchain firms made last-minute submissions.<\/p>\n<p class=\"wp-block-paragraph\">Ripple, for example, has welcomed the SEC\u2019s proposal, urging the regulator to adopt the framework while recommending several refinements. The company particularly supports distinguishing cryptocurrencies from investment contracts but wants stronger legal certainty for token issuers, exchanges and secondary-market transactions.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"\/>\n<p class=\"wp-block-paragraph\">Meanwhile, the Stellar Development Foundation, the Cardano Foundation, Chainlink Labs, Hedera, Aptos Labs and Ava Labs praised the SEC\u2019s March 2026 interpretation, which sorted crypto assets into five categories, and the proposed rule built on it.<\/p>\n<p class=\"wp-block-paragraph\"><strong>Related:<\/strong> <strong>Bitwise and Hyperliquid Push SEC for Clearer Crypto Rules as Consultation Closes<\/strong><\/p>\n<p class=\"wp-block-paragraph\">However, they took issue with the fact that the \u201cdigital commodity\u201d category appears only in the explanatory preamble, not in the rule text itself. They want it written into the rule so it becomes a durable legal standard rather than an interpretive position that could shift.
