The Clarity Act vote has been pushed into September after the US Senate left for its August recess without holding a vote, weakening prospects for the cryptocurrency legislation to clear Congress before the November midterm elections. Senate leaders have nevertheless kept the measure alive, with Majority Leader John Thune filing to prepare a procedural vote when lawmakers return in mid-September.
The legislation needs 60 votes to pass the Senate, meaning all voting Republicans and at least eight Democrats must back it. Republican leaders appear to believe that support could still be assembled, despite continued Democratic opposition to parts of the bill.

Senators Remain Divided
One of the main unresolved issues is an ethics provision governing cryptocurrency activity by government officials. Democrats are seeking stronger restrictions, while negotiations over how those rules would be enforced remain unsettled. A counterproposal from Senators Thom Tillis and Ruben Gallego has been sent to the White House, although its outcome remains unclear.
The September timetable presents another hurdle, with senators returning for only three weeks while facing competing legislative priorities. Republican senators have also raised concerns about provisions affecting stablecoins and community banks, suggesting further changes may be needed to secure broader support.
If approved, the Clarity Act would create a federal framework defining when digital tokens are treated as securities or commodities and establishing regulatory responsibilities. The crypto industry spent more than US$119 million (AU$169.0 million) backing pro-crypto candidates in the 2024 election, hoping to advance the legislation and stablecoin rules. The bill therefore enters September with a path forward, but limited time and unresolved disagreements leave its prospects uncertain.
