Stand With Crypto will track senators’ votes on the stalled CLARITY Act in its lawmaker scorecards ahead of November’s midterm elections, the Coinbase-backed advocacy group said Tuesday, hours after the US Senate voted 49-50 against taking up the bill.
Cloture on the motion to proceed to H.R. 3633, the Digital Asset Market Clarity Act, needed 60 votes on the September 15 roll call, where every Democrat voted no, joined by Republicans Susan Collins, Josh Hawley, Jerry Moran and Thom Tillis, with one senator not voting.
Tillis reportedly entered a motion to reconsider, a step that lets the chamber bring the bill back to the floor.
Today’s vote was a failure of leadership. 67 million crypto-owning Americans have waited years for basic clarity needed to use, build, and invest in digital assets safely.

A key vote alert issued the day before the vote had told senators that both the cloture motion and any final-passage vote would be scored and displayed on the group’s Voter Hub, the platform that grades lawmakers on their digital asset records.
The alert cited a coalition letter signed by more than 200 industry groups and startups, nearly 30,000 petition signatures gathered in three days, and what the group says are more than 1 million advocate contacts to Congress in support of the bill.
Stand With Crypto, which counts about 3 million advocates, has also endorsed 32 House incumbents for November, a bipartisan slate of 18 Republicans and 14 Democrats announced on August 24.
“Crypto Voters have become a durable, motivated voting bloc, which has the potential to swing key congressional races in the midterms”, Lynaugh said.
Ethics Language Sank the Motion
Democrats who opposed the motion pointed to the bill’s ethics provisions, arguing the language fell short on conflicts of interest tied to senior officials’ digital asset ventures, including the president’s.
Senate Republicans had released a revised 630-page substitute on September 10, with Senator Cynthia Lummis saying the text carried more than 114 provisions added at her Democratic colleagues’ request.
The House passed the CLARITY Act 294-134 in July 2025, and the Senate teed up this cloture test in its final sitting week before the August recess, the same schedule SEC Chair Paul Atkins pointed to when he backed the bill.
State attorneys-general had urged senators to reject the text unless it preserved state enforcement powers. The bill remains on the Senate calendar.
